GREEN AMENDMENTS STATES' PROGRESS REPORT
"There oughta be a law" to protect clean air, clean water, sane energy, wildlife and their habitat. Well there is! Some states have one right in their constitutions and 20 more states have proposed one. It's the Green Amendment. The Green Amendment gives power back to the people.
Many laws are written to be on the side of industry, no matter how polluting. The Green Amendment transforms the system and gives the people of their state power on their side. They have been proposed in both red and blue states, and are often bipartisan. Green Amendments help combat bad laws. And support good ones. Federal protection rollbacks make this more important, but we needed it before, anyway. "Democracy is eternal vigilance" We'll talk about how various states are handling their proposed Green Amendments.
The Green Amendment:
(a) Every person has a right to a clean and healthy environment, including pure water, clean air, and ecologically healthy habitats, and to the preservation of the natural, scenic, historic, and esthetic qualities of the environment. The State shall not infringe upon these rights, by action or inaction.
(b) The State's public natural resources, among them its waters, air, flora, fauna, climate, and public lands, are the common property of all the people, including both present and future generations. The State shall serve as trustee of these resources, and shall conserve and maintain them for the benefit of all people.
(c) This paragraph and the rights stated herein are (1) self-executing, and (2) shall be in addition to any rights conferred by the public trust doctrine or common law.
